Terms of Service

Please read these Terms of Service ("Terms") carefully before using Perfect Passport. These Terms are a binding legal agreement between you ("you" or "User") and Perfect Passport LLC, a Delaware limited liability company ("Perfect Passport," "we," "us," or "our"). By accessing or using our website at perfectpassport.com, our mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
IMPORTANT: Section 17 contains a binding arbitration agreement and a class action waiver that affect your legal rights. Please read it carefully. You may opt out of arbitration within 30 days of first accepting these Terms.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is not directed to children under 18, and we do not knowingly collect personal information from anyone under 18.
You may use the Service on behalf of another person (for example, ordering a child's passport photo as their parent or legal guardian), but you remain responsible for compliance with these Terms and for the accuracy of all information and images submitted.
2. Description of the Service
Perfect Passport provides software that helps users prepare photographs for passports, visas, government identification documents, and similar purposes. The Service automatically sizes, centers, edits, and validates uploaded photographs against published rules for various jurisdictions and document types, and delivers the result as a digital download and/or as physical prints shipped to an address you provide.
We may add, modify, or discontinue features, supported document types, supported jurisdictions, or other aspects of the Service at any time without notice.
3. Accounts and Order Lookup
The Service does not require you to create a user account. When you place an order, you provide an email address ("Order Email"), which serves as your reference for retrieving and managing that order. You are responsible for:
- providing an accurate Order Email and other order information;
- safeguarding access to the inbox associated with your Order Email; and
- all activity that occurs in connection with your Order Email.
We are not responsible for losses arising from inaccurate contact information or unauthorized access to your email account.
4. Orders, Pricing, and Payment
4.1 How Orders Work
You may upload a photograph and use our processing tools without charge to preview a compliant version. You are charged only when you purchase a digital download, physical prints, or reprints of a previously processed photograph.
4.2 Pricing
Prices are displayed in the Service at the time of purchase and are subject to change. Applicable taxes, shipping fees, and other charges will be itemized at checkout where required.
4.3 Payment Processing
All payments are processed by Stripe, Inc. ("Stripe"). By providing payment information, you authorize us and Stripe to charge the applicable amounts. Your use of Stripe is also subject to Stripe's terms and privacy policy. We do not collect or store full payment card numbers on our systems.
4.4 Order Confirmation
An order is accepted only when we send you an order confirmation. We may refuse, cancel, or limit any order at our discretion, including for suspected fraud, payment failure, pricing errors, or violations of these Terms.
5. Digital Downloads
Digital downloads are made available promptly after payment is confirmed. You are responsible for downloading and saving the file. Digital download links may expire after a reasonable period.
6. Physical Prints and Shipping
6.1 Shipping
Where you order physical prints, we will arrange for production and shipment using a carrier of our choosing. Estimated delivery times displayed in the Service are estimates only and are not guaranteed. Title and risk of loss for physical prints transfer to you upon delivery to the carrier.
6.2 Address Accuracy
You are responsible for providing an accurate, complete shipping address. We are not responsible for delays, non-delivery, or additional shipping costs resulting from inaccurate addresses, refusals of delivery, or customs holds.
6.3 International Shipments
For shipments outside the United States, you are the importer of record and are responsible for any duties, taxes, customs fees, or restrictions imposed by the destination country.
7. Refunds
7.1 Acceptance Refund
If a photograph processed by the Service is rejected by, or cannot be accepted by, the issuing authority (for example, a passport agency, embassy, consulate, DMV, or equivalent body) for reasons attributable to the photograph itself, we will refund the amount you paid for that photograph upon receipt of reasonable evidence of the rejection (such as a written notice or email from the issuing authority).
7.2 Requesting a Refund
To request a refund, contact us at legal@perfectpassport.com within 90 days of the rejection. We may request additional information to evaluate your claim.
7.3 What Is Not Covered
Refunds are not available for: photographs rejected for reasons unrelated to the photograph (for example, missing forms or fees, identity documentation issues, or applicant ineligibility); user error in selecting the wrong document type or country; or shipping costs, except where required by law.
7.4 Method of Refund
Refunds are issued to the original payment method through Stripe.
8. No Guarantee of Acceptance
The Service is a tool that assists you in preparing photographs against published rules. We do not guarantee, and we cannot guarantee, that any photograph processed by the Service will be accepted by any government, agency, embassy, consulate, or other issuing authority.
You acknowledge that:
- official requirements change frequently and may differ in practice from published rules;
- human reviewers exercise judgment and may apply rules inconsistently;
- factors outside our control — including lighting, image quality of your source photo, your appearance on the day of submission, and policies of individual reviewers — may cause a compliant photograph to be rejected; and
- you are solely responsible for selecting the correct country and document type and for following all submission procedures of the relevant authority.
Our acceptance refund described in Section 7.1 is your sole and exclusive remedy in the event of rejection.
9. Your Photographs and Other Content
9.1 Ownership
You retain all rights you have in any photographs and other materials you upload to the Service ("User Content"). We do not claim ownership of your User Content.
9.2 License to Us
You grant Perfect Passport a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, modify, format, and reproduce your User Content solely for the purpose of providing the Service to you (including processing, producing, and delivering digital and physical outputs of your order). This license terminates when your User Content is deleted from our systems in accordance with Section 10.
9.3 No Other Use
We do not use your User Content for advertising, marketing, training machine learning models, or any purpose other than providing the Service to you and complying with law. We do not sell your User Content.
9.4 Your Representations
You represent and warrant that: (a) you own the User Content you upload or have all rights necessary to upload it; (b) the User Content depicts you or a person on whose behalf you are authorized to act; and (c) your upload and use of the User Content does not violate any law or any third party's rights.
10. Photo Retention and Deletion
We retain User Content only as long as needed to provide the Service. Specifically:
- You may delete uploaded photos at any time from within the app or by contacting us at legal@perfectpassport.com.
- Automatic deletion: Uploaded photos that are not associated with a completed purchase are automatically deleted 30 days after upload.
- Completed orders: Photos associated with completed orders may be retained for a reasonable period to enable reprints and order support, and will be deleted upon your request.
We may retain limited transactional records (such as order numbers and receipts) as required by law or for legitimate business purposes such as tax, accounting, and fraud prevention.
11. Acceptable Use
You agree not to:
- upload any image other than a photograph of yourself or a person you are authorized to act on behalf of;
- upload images of another person without their consent (or, for minors, without the consent of their parent or legal guardian);
- upload images that are unlawful, obscene, sexually explicit, or that depict minors in any compromising manner;
- use the Service to facilitate identity fraud, impersonation, document forgery, or any other unlawful purpose;
- reverse engineer, decompile, scrape, or attempt to derive the source code or underlying algorithms of the Service except to the extent expressly permitted by law;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or any system or network connected to it;
- use any automated means (bots, scrapers, etc.) to access the Service except as expressly permitted by us; or
- resell, sublicense, or commercially exploit the Service without our prior written consent.
We may suspend, terminate, or refuse access to anyone we believe is violating these Terms.
12. Intellectual Property
The Service — including all software, designs, text, graphics, logos, trademarks, and other content (excluding User Content) — is owned by Perfect Passport or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. No other rights are granted by implication, estoppel, or otherwise.
"Perfect Passport" and our logos are trademarks of Perfect Passport LLC. You may not use them without our prior written permission.
13. Mobile Applications
If you download our mobile application from the Apple App Store or Google Play Store, the following additional terms apply.
13.1 Apple App Store
These Terms are between you and Perfect Passport, not Apple Inc. ("Apple"). Apple is not responsible for the Service or its content. Your license to use the iOS app is limited to use on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. Apple has no obligation to provide maintenance or support for the iOS app. To the maximum extent permitted by law, Apple has no warranty obligation, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility. We are responsible for addressing any claims by you or a third party relating to the iOS app, including product liability claims, claims that the iOS app fails to conform to legal requirements, and claims arising under consumer protection or similar legislation. In the event of any third-party claim that the iOS app or your possession and use of it infringes that third party's intellectual property rights, we (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of such claim. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13.2 Google Play Store
If you obtained our app from Google Play, you acknowledge that Google Inc. ("Google") is not a party to these Terms and has no obligations with respect to the app. Google is not responsible for the Service or its content, and your use of the app must also comply with the then-current Google Play Terms of Service.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
15. Disclaimers of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFECT PASSPORT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY PHOTOGRAPH WILL BE ACCEPTED BY ANY GOVERNMENT OR ISSUING AUTHORITY; (C) THE PUBLISHED RULES AGAINST WHICH WE VALIDATE PHOTOGRAPHS ARE CURRENT OR COMPLETE FOR ALL JURISDICTIONS AT ALL TIMES; OR (D) ANY DEFECTS WILL BE CORRECTED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PERFECT PASSPORT, ITS AFFILIATES, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).
WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY COSTS YOU INCUR AS A RESULT OF A REJECTED OR DELAYED APPLICATION FOR ANY DOCUMENT, INCLUDING APPLICATION FEES, EXPEDITING FEES, TRAVEL COSTS, MISSED FLIGHTS, MISSED EVENTS, OR LOST OPPORTUNITIES.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
17. Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
17.1 Agreement to Arbitrate
Except for disputes described in Section 17.2, you and Perfect Passport agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted by a single arbitrator. The arbitrator has exclusive authority to resolve any Dispute, including the scope and enforceability of this arbitration agreement.
17.2 Exceptions
Either party may bring an individual action in small claims court for a Dispute within the court's jurisdiction. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction for actual or threatened infringement, misappropriation, or violation of intellectual property rights.
17.3 Class Action Waiver
YOU AND PERFECT PASSPORT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
17.4 Opt-Out Right
You may opt out of this arbitration agreement and class action waiver by sending written notice to legal@perfectpassport.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Your notice must include your full name, mailing address, the email address you used with the Service, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.
17.5 Procedure
Before filing for arbitration, the complaining party must send a written description of the Dispute to the other party (to legal@perfectpassport.com if directed to us) and allow 60 days for the parties to attempt to resolve the Dispute informally. Unless the parties agree otherwise, the arbitration will be conducted in English in the U.S. county where you reside, or by video or telephone. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
17.6 Severability of This Section
If the class action waiver in Section 17.3 is found unenforceable as to any claim, that claim shall be severed and proceed in court, while the remaining claims shall proceed in arbitration.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to Section 17, any Dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
19. Indemnification
You agree to defend, indemnify, and hold harmless Perfect Passport and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.
20. Modifications to the Service or Terms
We may modify the Service at any time, including by adding or removing features, supported jurisdictions, or document types. We may also modify these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by updating the "Last Updated" date above and, where appropriate, by email or in-app notice). Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of them. If you do not agree, you must stop using the Service.
21. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, the provisions of these Terms that by their nature should survive — including Sections 7, 8, 9.4, 12, 14–19, and 22 — will survive.
22. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy and any order confirmations, constitute the entire agreement between you and Perfect Passport regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, internet or telecommunications failures, government action, or natural disasters.
Notices. Notices to us must be sent to legal@perfectpassport.com. We may provide notices to you by email at the address associated with your most recent order, by posting in the Service, or by other reasonable means.
Headings. Section headings are for convenience only and do not affect interpretation.
